1. Introduction
1.1 Purpose
These Terms of Service (“Terms”) govern your use of Rent a Mac’s services and website. By using our services, you agree to the terms outlined in this agreement, which form a legally binding contract between you (“the user”) and WLF Digital Solutions LTD. This agreement protects both parties by setting clear expectations regarding the use of our services.
1.2 Acceptance
By accessing or using our services, you agree to comply with these Terms. If you do not agree to these Terms or any part of our policies, including our Privacy Policy and Acceptable Use Policy, you may not use our services. WLF Digital Solutions LTD reserves the right to update these Terms at any time, with changes effective upon publication on our website. It is your responsibility to review the Terms periodically.
2. Services Provided
2.1 Description
Rent a Mac offers remote Mac rental services, providing access to premium macOS environments tailored to individual and business needs. Our services are designed for various professional purposes, including software development, graphic design, and testing environments.
2.2 Eligibility
To access our services, you must be at least 18 years old or the legal age of majority in your jurisdiction. By registering, you confirm that you meet this requirement and are legally authorized to enter into this agreement. Accounts created by individuals who do not meet this requirement are subject to suspension or termination without prior notice.
3. User Responsibilities
3.1 Account Information
You are required to provide accurate, complete, and current information during the registration process. It is your responsibility to keep your account details updated, including email and billing information. Providing false or misleading information may result in account suspension or termination.
3.2 Compliance
You agree to use the services in accordance with all applicable laws, regulations, and these Terms. Unauthorized sharing of your account credentials is prohibited. You are solely responsible for any activity conducted through your account and must notify us immediately of any unauthorized access or security breaches.
4. Acceptable Use Policy
4.1 Prohibited Activities
You agree not to engage in any of the following activities:
4.1.1 Unauthorized Access
Attempting to gain unauthorized access to other systems, accounts, services, or networks.
4.1.2 Malicious Software
Engaging in activities that distribute, host, execute, or support malicious software, including viruses, malware, ransomware, spyware, or similar harmful code.
4.1.3 Illegal Activity
Conducting illegal activities, including but not limited to copyright infringement, fraud, unauthorized data mining, identity misuse, or any other activity prohibited by applicable law.
4.1.4 Spam and Abuse
Sending unsolicited emails (“spam”), bulk or automated messaging, operating open SMTP relays, mass account creation, or otherwise generating spam traffic, including traffic designed to manipulate analytics, ads, or reputation systems.
4.2 Enforcement
4.2.1 Suspension or Termination
Failure to comply with this policy may result in immediate account suspension or termination and potential legal action. WLF Digital Solutions LTD reserves the right to monitor usage and investigate any suspected violations.
4.2.2 Suspicious or Harmful Activity
At our sole discretion, if unusual, suspicious, or potentially harmful activity is detected, WLF Digital Solutions LTD may suspend or block the user’s account, revoke access to the rented Mac(s), and wipe any associated data without prior notice.
4.2.3 No Refund for Violations
If action is taken due to a violation or suspected harmful activity, no refund will be issued, regardless of the remaining subscription term.
4.2.4 KYC Verification
WLF Digital Solutions LTD reserves the right to require users to complete a Know Your Customer (KYC) verification process before restoring access.
4.2.5 Account Reactivation
If the KYC process is successfully completed, the user’s account may be reactivated and access to a rented Mac restored, depending on the severity and nature of the activity that led to the suspension.
4.2.6 Permanent Suspension
If the violation is deemed too severe, WLF Digital Solutions LTD reserves the right to permanently suspend the account even after KYC completion.
5. Subscription and Payment
5.1 Plans
5.1.1 Available Plans
We offer flexible subscription plans, detailed on our Pricing page. These plans cater to varying user needs, from daily rentals to long-term options.
5.1.2 Price Changes
Subscription rates are subject to change; however, users will be notified in advance of any changes affecting their current plans.
5.2 Payment Methods
5.2.1 Accepted Payment Methods
Payments are accepted via credit/debit cards and PayPal.
5.2.2 Payment Requirement
All payments must be completed at the time of subscription activation. Failure to process payment may result in suspension of services.
5.3 Billing Cycle
5.3.1 Automatic Renewal
Subscriptions renew automatically at the start of each billing cycle.
5.3.2 Renewal Notifications
Users will be notified of upcoming renewals via email.
5.3.3 Cancellation Responsibility
It is the user’s responsibility to manage cancellations to avoid automatic renewals.
5.4 Renewal Payment Failure and Data Wipe
5.4.1 Grace Period
If a renewal payment cannot be processed, WLF Digital Solutions LTD may allow the rented Mac to remain online for a limited grace period while further payment attempts are made.
5.4.2 Retry Attempts
During the grace period, the Company may retry the payment up to three times.
5.4.3 Email Notifications
The user will receive an email notification following each failed payment attempt, providing an opportunity to update the payment method or pay the outstanding invoice before any loss of access or data occurs.
5.4.4 Automatic Data Wipe
If payment is not successfully completed during the grace period, the rented Mac may be automatically wiped.
5.4.5 Scope of Data Wipe
The wipe permanently erases all data, files, settings, and installed software on the Mac.
5.4.6 Unrecoverable Process
The wipe is automated, final, and unrecoverable.
5.4.7 User Responsibility
Users are responsible for maintaining a valid payment method with sufficient available funds before each renewal date.
5.4.8 Outstanding Invoice Payment
If a payment failure notification is received, the user should promptly pay the outstanding invoice through the Invoices page or update their payment information.
5.4.9 Cancelled Subscriptions
If a subscription has been cancelled, the rented Mac will be wiped on the subscription expiration date unless the subscription is reactivated before that date.
5.4.10 No Liability for Data Loss
WLF Digital Solutions LTD is not responsible for any data loss resulting from failed renewal payments, expired subscriptions, or failure to reactivate a subscription before expiration.
6. Cancellation and Refunds
6.1 Cancellation
6.1.1 Cancellation Method
Users may cancel their subscriptions at any time through their account settings.
6.1.2 Cancellation Deadline
Cancellation requests must be submitted before the next billing cycle to avoid charges for the subsequent period.
6.1.3 Access After Cancellation
Access to services will remain active until the end of the current billing cycle.
6.2 Refunds
6.2.1 Refund Eligibility
Refunds are issued only in cases where services were unavailable due to technical issues or server unavailability.
6.2.2 Refund Request Deadline
Requests for refunds must be submitted within 14 days of the incident.
6.2.3 Discretionary Refunds
Refunds for unused time are issued at WLF Digital Solutions LTD’s discretion.
6.3 Disputes
6.3.1 Payment Disputes
In the event that any transaction or payment made by a user is disputed, WLF Digital Solutions LTD reserves the absolute right, without prior notice, to immediately suspend or terminate all active subscriptions associated with the user’s account.
6.3.2 Device Wipe Upon Dispute
Upon such termination, all rented devices, including but not limited to Mac instances, shall be remotely wiped, and the corresponding rental agreements shall be deemed terminated with immediate effect.
6.3.3 Refusal of Future Services
WLF Digital Solutions LTD shall not provide, rent, or otherwise make available any new devices or services to users involved in payment disputes, irrespective of the outcome of such disputes.
6.3.4 Protective Actions
The Company further reserves the right to take any actions it deems necessary to safeguard its systems, infrastructure, and proprietary interests, including but not limited to data removal, access revocation, and the pursuit of any remedies available under applicable law.
7. Data Privacy and Security
7.1 Jurisdiction
These Terms are governed by the laws of Cyprus. Any disputes arising from this agreement will be resolved in the courts located in Cyprus.
8. Changes to Terms
8.1 Modifications
WLF Digital Solutions LTD reserves the right to modify these Terms at any time. Changes will be effective upon publication on our website. Users are encouraged to review the Terms periodically to stay informed of updates.
